Carson City Supervisors to consider lawsuit settlements, water and sewer bonds

The Carson City Board of Supervisor will consider settlements in two lawsuits alleging misconduct by city employees at the board's next meeting on Dec. 15.

One lawsuit involves the case of Aaron Lewis, the former Carson City Alternative Sentencing officer who is facing a Feb. 21 trial for allegedly molesting six women while on duty. The District Attorney's office has negotiated an amount of $67,500 with one of the victims, Melissa Mulder, for "full settlement of all existing and any potential future claims, causes of action and damages against Carson City...."

Mulder was on probation for a drug arrest and Lewis was the officer assigned to her case. Mulder alleged that Lewis in one incident forced her to "expose her breasts and genitals to him,” and “urinate in his presence.” In another incident, he threatened Mulder with jail unless she met him in his car, where he allegedly subjected her to a "more invasive examination of her breasts and genitals."

Once Mulder's case became public, more women came forward with similar stories about Lewis.

The second lawsuit settlement for $60,000 is for Elvin Lee Fred, who "alleges to have been wrongfully arrested and subjected to excessive force in violation of his federal constitutional rights and in violation of Nevada state law."

The case involved Fred being arrested at the Carson Nugget on Jan. 20, 2009.

The staff summary reads "Plaintiff seeks damages for personal injuries, emotional distress, attorney’s fees and costs, and punitive damages against the individual officers. Plaintiff also seeks damages directly against Carson City based upon the alleged existence of an unlawful custom and practice which allegedly caused the constitutional violations in question and for its alleged failure to adequately hire, train and supervise Deputy Bueno and Deputy Underhill."

The settlements are on the board's consent agenda and will not be opened up to extensive discussion unless a citizen or board member objects, and then the the item will be separated out for individual action.

The supervisors will also consider for possible action:

  • To adopt a "resolution authorizing the City manager or Finance Director to arrange for the sale of general obligation (limited tax) water bonds (additionally secured by pledged revenues) and general obligation (limited tax) sewer bonds (additionally secured by pledged revenues)." They are anticipating issuing $3,725,000 in new money for water bonds, $2,250,000 in new money for sewer bonds and $16,000,000 in possible water and sewer refunding bonds.
  • The addition of an upper level staff member to manage the process of collection and analysis of performance data of the activities and functions of the city departments
  • To accept the Carson City Comprehensive Annual Financial Report for the fiscal year ended June 30, 2011
  • To adopt a resolution accepting an inter-local agreement in the amount of $387,351 per year with Douglas County for Carson City Health and Human Services (CCHHS) to provide community health nursing services in Douglas County
  • To approve and authorize the Mayor to sign a Memorandum of Understanding between the Board of Regents of the Nevada System of Higher Education on behalf of the University of Nevada, Reno, the Nevada Small Business Development Center (NSBDC) and Carson City, for the purpose of providing a framework for cooperation between NSBDC and the City in establishing services at the BRIC (Business Resource Innovation Center)
  • Adoption, on second reading, new ward boundaries
  • A series of zoning changes to land purchased by the city's open space program
